Terms and Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Cooling-off period: the period within which the consumer can exercise their right of withdrawal;
Consumer: the natural person who is not acting in the course of a profession or business and enters into a distance contract with the entrepreneur;
Day: calendar day;
Long-term transaction: a distance contract relating to a series of products and/or services, where the delivery and/or purchase obligation is spread over time;
Durable medium: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.
Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period;
Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance;
Distance contract: an agreement concluded within the framework of an organized system for distance selling of products and/or services, where only one or more means of distance communication are used up to and including the conclusion of the agreement;
Means of distance communication: any method that can be used to conclude an agreement without the consumer and entrepreneur being in the same place at the same time;
Terms and Conditions: the present Terms and Conditions of the entrepreneur.
Article 2 – Applicability
These terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the contract is concluded that the terms can be inspected at the entrepreneur’s premises and will be sent free of charge upon request.
If the contract is concluded electronically, the terms may be provided electronically in such a way that the consumer can easily store them on a durable medium.
If specific product or service conditions also apply, the consumer may always rely on the provision most favorable to them in case of conflicting conditions.
If any provision is null or void, the remainder of the agreement remains valid, and the provision will be replaced with one that most closely reflects the original intent.
Situations not covered by these terms must be assessed in the spirit of these terms.
Article 3 – The Offer
If an offer has a limited validity or is subject to conditions, this will be explicitly stated.
The offer is non-binding. The entrepreneur may change or adjust the offer.
The offer contains a complete and accurate description of the products and/or services. Images are a truthful representation but may not exactly match actual colors.
Obvious errors or mistakes do not bind the entrepreneur.
All images and specifications are indicative and cannot lead to compensation or termination of the agreement.
Each offer includes information such as:
- the price (excluding import duties and VAT where applicable),
- shipping costs,
- how the agreement is concluded,
- whether the right of withdrawal applies,
- payment, delivery, and execution methods,
- acceptance period,
- applicable communication costs,
- whether the agreement is archived,
- how the consumer can check and correct data,
- available languages,
- applicable codes of conduct,
- minimum duration (for long-term contracts).
Article 4 – The Agreement
The agreement is concluded when the consumer accepts the offer and meets the stated conditions.
If accepted electronically, the entrepreneur will confirm receipt immediately.
The entrepreneur ensures appropriate security measures for electronic transactions.
The entrepreneur may investigate whether the consumer can meet payment obligations and may refuse an order if justified.
The consumer will receive information such as:
- business contact details,
- conditions for withdrawal,
- warranty information,
- termination conditions (if applicable).
All agreements are subject to product availability.
Article 5 – Right of Withdrawal
Consumers may cancel the purchase within 30 days without giving any reason.
The cooling-off period starts the day after the product is received.
The consumer must handle the product carefully and return it in original condition and packaging where possible.
The consumer must notify the entrepreneur within 30 days and return the product within 30 days after notification.
Proof of return shipment is required.
If the deadlines are not met, the purchase becomes final.
Article 6 – Costs in Case of Withdrawal
Return shipping costs are borne by the consumer.
Refunds will be issued within 30 days after withdrawal, provided the product has been received or proof of return is supplied.
Article 7 – Exclusion of Right of Withdrawal
The right of withdrawal may be excluded for:
- custom-made products,
- personal items,
- perishable goods,
- sealed items opened by the consumer (e.g., hygiene products, software),
- newspapers and magazines,
- services like accommodation, transport, or leisure activities on specific dates,
- services started with consumer consent before the cooling-off period ends,
- gambling and lotteries.
Article 8 – Prices
Prices will not increase during the validity period unless due to VAT changes.
Variable pricing may apply for market-dependent products.
Price increases within 3 months are only allowed if legally required.
All prices exclude import VAT and clearance costs where applicable.
Typographical errors do not bind the entrepreneur.

Article 10 – Conformity and Warranty
Products must conform to the agreement and legal requirements.
Warranty does not affect statutory rights.
Defects must be reported within 30 days.
Warranty does not apply in cases of misuse, unauthorized repairs, or improper handling.
Article 11 – Delivery and Execution
Orders will be processed with care and delivered within 30 days unless otherwise agreed.
If delivery is delayed, the consumer may cancel the agreement.
Risk transfers upon delivery.
Article 12 – Duration Transactions
Consumers may terminate agreements with a maximum notice period of one month.
Automatic renewals are restricted and must comply with legal rules.
Article 13 – Payment
Payments must be made within 7 working days unless agreed otherwise.
Incorrect payment details must be reported immediately.
Article 14 – Complaints Procedure
Complaints must be submitted within 7 days after discovery.
They will be answered within 30 days.
If unresolved, a dispute may arise.
Article 15 – Disputes
Dutch law applies to all agreements, even if the consumer resides abroad.
Article 16 – CESOP
Due to regulations effective from 2024 regarding payment services, payment providers may register data in the European CESOP system.
